Friend loans & the IRS. To avoid the loan being treated as a gift, charge at least the Applicable Federal Rate (AFR) shown above for your term, and put it in writing. Under IRC §7872, gift loans of $10,000 or less are generally exempt from imputed-interest rules; for loans of $100,000 or less, imputed interest is capped at the borrower's net investment income (treated as $0 if that income is $1,000 or less).
